Holiday Rental Accommodation Contract

This Holiday Rental Accommodation Contract (hereinafter referred to as “Agreement”) is made and entered into between the Owner/Manager/Host and the Guest, as defined below, for the short-term rental of the Property.
IMPORTANT NOTICE: This Agreement constitutes a license to occupy the Property for the specified rental period. It is not a residential tenancy agreement under any landlord-tenant legislation, nor does it grant any long-term rights of tenancy or ownership. The Guest has no right to use the Property as their home, permanent residence, or for any business purposes.
1 Parties to the Agreement
1.1. Owner/Manager: CMP LandSol Limited, 14 Main Street, Wetwang, YO25 9XJ, United Kingdom (Hereinafter referred to as “Owner”)
1.2. Guest: The Guest’s details (Full Legal Name, Permanent Residential Address, Contact Email, Contact Phone Number) are as provided in the confirmed booking details. (Hereinafter referred to as “Guest”)
2 Property Details
2.1. Property Address: Åsvegen 469, 2030 Nannestad
2.2. Description of Property: A fully furnished 1 bedroom, 1 bathroom holiday home/apartment, including a kitchen, living area, dining area, garden.
2.3. Maximum Occupancy: The maximum number of persons permitted to stay at the Property at any time is 3. Exceeding this number without prior written consent from the Owner may result in immediate termination of this Agreement and forfeiture of all monies paid.
3 Rental Period
3.1. Short-Term Rental: This Agreement is for a short-term holiday rental only, for a period not exceeding thirty (30) days. The rental period is strictly limited to the Check-in Date and Check-out Date as specified in the confirmed booking details.

3.3. Check-out Date: As per confirmed booking details.
3.4. No Right to Permanent Residence: The Guest acknowledges and agrees that this Agreement does not create a landlord-tenant relationship, and the Guest has no right to use the Property as their home, permanent residence, or for any business purposes. The Property is provided solely for the purpose of short-term holiday accommodation.
3.5. Overstaying: Any unauthorised overstay beyond the agreed Check-out Date and Time will result in additional charges, including but not limited to, a daily rate of 200% of the original booking day rate for each day or part thereof the Guest remains in the Property, plus any legal costs incurred by the Owner to regain possession.
4 Payment Terms

4.4. Security Deposit: See booking details. This deposit is held against any damages to the Property or its contents, excessive cleaning requirements, or breach of this Agreement. The deposit will be refunded within 14 days after check-out, provided the Property is left in a satisfactory condition, less any deductions for damages or breaches.

5 Guest Obligations
5.1. Care of the Property: The Guest agrees to take all reasonable care of the Property and its contents and to leave the Property in a clean and tidy condition at the end of the rental period. Any damage or breakages must be reported to the Owner immediately.
5.2. Prohibited Activities: The Guest shall not: a. Use the Property for any illegal or immoral purpose. b. Cause nuisance or annoyance to neighbours or other occupants of the building/area. c. Conduct any business activities from the Property. d. Make any alterations to the Property. e. Smoke inside the Property. f. Keep any pets on the Property unless explicitly agreed upon in writing by the Owner.
5.3. Noise and Conduct: Guests are expected to behave in a respectful manner and keep noise to a minimum, especially between during unsociable hours. Parties or large gatherings are strictly prohibited unless prior written consent is obtained from the Owner.
5.4. Utilities and Waste: Guests are requested to be mindful of utility consumption (electricity, water, heating). Waste must be disposed of properly in designated bins and according to local recycling guidelines.
5.5. Keys and Security: The Guest is responsible for the safekeeping of keys/access codes. Lost keys may incur a replacement fee. The Guest must ensure all doors and windows are locked when leaving the Property.
6 Owner’s Rights and Responsibilities
6.1. Provision of Property: The Owner agrees to provide the Property in a clean, safe, and habitable condition for the duration of the rental period.
6.2. Access to Property: The Owner or their authorised representative reserves the right to enter the Property at a reasonable time for inspection, maintenance, or in case of emergency, with prior notice where practicable.
6.3. Maintenance and Repairs: The Owner will endeavour to resolve any maintenance issues promptly. The Owner is not responsible for any inconvenience caused by unforeseen events or circumstances beyond their control (e.g., power outages, internet failures).
7 Cancellation Policy
7.1. Cancellation by Guest: See booking details
7.2. Cancellation by Owner: In the unlikely event that the Owner must cancel the booking due to unforeseen circumstances (e.g., damage to the Property, force majeure), the Owner will provide a full refund of all monies paid by the Guest. The Owner will not be liable for any additional costs incurred by the Guest (e.g., travel expenses).
8 Liability and Indemnity
8.1. Owner’s Liability: The Owner shall not be liable for any loss, damage, injury or death to the Guest or their property, or to any third party, arising out of or in connection with the Guest’s use of the Property, except where such loss, damage, injury or death is caused by the Owner’s gross negligence or wilful misconduct.
8.2. Guest’s Indemnity: The Guest agrees to indemnify and hold harmless the Owner from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from the Guest’s use of the Property, including but not limited to, any breach of this Agreement, damage to the Property, or injury to third parties caused by the Guest.
9 Governing Law and Dispute Resolution
9.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Norway.
9.2. Dispute Resolution: Any dispute arising out of or in connection with this Agreement shall first be attempted to be resolved through good faith negotiation between the parties. If a resolution cannot be reached, the parties agree to mediation, arbitration, or exclusive jurisdiction of the courts of the governing law.
10 General Provisions
10.1. Entire Agreement: This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.
10.2. Amendments: Any amendments or modifications to this Agreement must be in writing and signed by both parties.
10.3. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.4. Headings: The headings in this Agreement are for convenience only and shall not affect its interpretation.
By proceeding with the booking and payment, the Guest acknowledges that they have read, understood, and agree to abide by all the terms and conditions set forth in this Holiday Rental Accommodation Contract.
